CONTRACT TERMS

The following terms apply to all 307 Handyman jobs. When you accept our work estimate you are acknowledging that you have read and agree to these contract terms. If you have questions please contact us prior to submitting acceptance of our work estimate.

Contract Terms

Scope of Work
307 Handyman will perform handyman services at the address specified by the client in accordance with the detailed work estimate acknowledged either by electronic acceptance, written signature or payment of deposit.

 

Materials Price Increase

When the price for any materials to be used on the project increases five percent (5%) or more between the time of original estimate and the date of installation, 307 Handyman reserves the right to add the difference to customer's final invoice.  Proof of price change will be provided upon request. This includes but is not limited to price increases in lumber, plywood, steel, sheet metal, roofing materials, fuel, manufactured products, equipment rentals and transportation costs when applicable.


Change Orders
Client may make change requests to expand the scope of workduring the job. They acknowledge that additional work performed will be billed on final invoice for changes made. If client wishes to have pricing/changes documented prior to work being performed they may do so. 


Permission, Permits, Licensing & Approvals
The client acknowledges that they are the property owner or have acquired permission from the property owner for work to be completed. The client is responsible for procuring any permits or approvals required for the completion of the projects listed in the scope of work. This includes any zoning changes or changes to applicable covenants or local building guidelines. 307 Ha
ndyman shall be responsible for any professional licensing required for the execution of the work outlined in the scope of work and as such reserves the right to bring in 3rd party contractor to complete work as needed. 


Insurance & Loss Coverage
The client agrees to maintain adequate property insurance to protect against loss or damage due to theft, fire, vandalism, etc. 307 Handyman agrees to maintain reasonable liability insurance to protect against personal injury or loss.


Property Access
The client agrees to be present at the scheduled work time to ensure that 307 Handyman has reasonable access to the working area, including parking space. 307 Handyman agrees to contact the client 72 hours prior to arrival to schedule an appropriate arrival time and agrees to make a reasonable effort not to disturb or damage the client's property outside of any demolition required for the project listed in the scope of work.


Site Conditions
The scope of work and pricing for this contract is based on conversations and any walkthroughs completed by 307 Handyman and the client. 307 Handyman has taken reasonable measures to ensure that the scope of work and pricing represent the entire project requirements but cannot guarantee a final price due to the possibility of unforeseen complications or fluctuations in materials pricing. In the event that unforeseen complications, including (but not limited to) mold, termites, structural damage, or building code violations are discovered after the project begins, 307 Handyman will cease work on the project and draft a change order listing any additionally required materials or labor. The client agrees that any unforeseen complications may increase the final price of the project.

Project Specific Information

   Drywall Repairs, Ceiling or Wall Texture - When repairing drywall is can not be guaranteed that blemishes can be completely masked. We will use our expertise and industry best practices to make repairs as invisible as possible. Matching existing texture is often not possible. If you require a completely flawless texture, please specify this at time of contracting so that retexturing of the entire surface will be included in the bid. By accepting this contract, you acknowledge that slight variations in surface smoothness/texture may be present unless otherwise specified in the contract. 

   Paint/Stain - Trying to match existing stain, paint or sheen may not always be possible. Spot paint/staining is not recommended. Whether spot painting or painting the entire area, if 307 Handyman provides paint color/sheen, client is to sign off on selection prior to purchase and recognizes that should client choose to change selection, labor and paint costs will be incurred. If client provides paint, 307 Handyman holds no liability for dissatisfaction with color or sheen. If client decides they want a different selection, labor and materials will be charged for changes.


Payment Schedule 
The client agrees to make payments in accordance with the payment schedule noted on their estimate and recognizes that no work or scheduling will begin until the deposit has been received unless otherwise noted on the estimate. The client will be notified at least 24 hours in advance of project completion. If final payment is not made in accordance with the payment within 72 hours of completion, a financing fee of 5% of the total project cost will be assessed along with an additional 18% apr, compounding daily assessed for each day thereafter. 307 Handyman retains the right to place a lien on the client's property and will fully release the lien upon receipt of final payment and financing fees from the client.


Final Inspection
The day that work is completed, the client will have the opportunity to review all completed work with 307 Handyman. The client will have the opportunity to identify any incomplete or unsatisfactory work and is authorized to withhold final payment until such issues are addressed.


Warranty
307 Handyman does not offer or imply any warranty for materials used for the project. Any defect or failure of parts or materials used in the project shall be the sole responsibility of the client and addressed with the product manufacturer/provider. 307 Handyman shall extend a warranty for all labor for a period of 6 months. This warranty covers installation and workmanship. Should the client discover any incomplete, incorrect, faulty, or failed workmanship during the warranty period, 307 Handyman shall correct such issues at their sole cost and expense.


Dispute Resolution
307 Handyman and the client agree to make reasonable efforts to resolve any disagreements related to this contract between themselves. In the event that the two parties cannot agree on an issue, both parties agree to resolve the issue through a civil court located in Casper, WY. The decision of that court shall be considered final.

 

Governing Law
This handyman services contract shall be governed by the laws of Wyoming.
